Acceptable Use Policy

You are responsible for all prompts, files, data, instructions, links, presentations, images, documents, messages, and other material that you submit to, create with, publish through, or share using the Services (“Content”), including Content produced with AI assistance.

AI-generated Content may be incomplete, inaccurate, or unsuitable for a particular purpose. You remain responsible for how you use it.

You may not use, or help another person use, the Services to create, upload, store, edit, publish, distribute, advertise, promote, solicit, or otherwise facilitate any of the following:

1. Illegal activity. Content or conduct that violates, promotes, facilitates, or provides actionable instructions for violating applicable law.
2. Child sexual abuse or exploitation. Any sexualization, exploitation, grooming, trafficking, or abuse of a minor, including synthetic or AI-generated material. Suspected child sexual abuse material may be reported to the appropriate authorities as required by law.
3. Sexual exploitation and non-consensual intimate content. Sexually exploitative content; intimate content created or shared without consent; or content used to threaten, extort, or harass a person.
4. Graphic, obscene, or dangerous content. Content that is unlawfully obscene, depicts extreme gore for shock value, promotes terrorism or violent extremism, credibly threatens public safety, or encourages suicide or self-harm.
5. Hate and discrimination. Content or conduct that promotes hatred, violence, dehumanization, or unlawful discrimination against a person or group based on a protected or similarly sensitive characteristic.
6. Harassment, threats, and abuse. Bullying, stalking, intimidation, credible threats, targeted abuse, or unlawful defamation.
7. Fraud and deception. Scams, phishing, fraudulent schemes, counterfeit documents, deceptive impersonation, fabricated endorsements, manipulated media used to mislead, or materially false claims intended to cause financial or other harm.
8. Identity misrepresentation. Impersonating a person or organization, falsely claiming authority or affiliation, or concealing the origin or nature of AI-generated Content where disclosure is required by law or where non-disclosure would be materially deceptive.
9. Privacy violations. Collecting, exposing, selling, or sharing another person’s personal, confidential, biometric, financial, health, authentication, or location information without a lawful basis and any required consent.
10. Intellectual property violations. Infringing or misappropriating copyrights, trademarks, patents, trade secrets, publicity rights, privacy rights, or other proprietary rights; or using Content that you do not have the right to use.
11. Malware and cybersecurity abuse. Developing, distributing, or deploying malware or harmful code; compromising accounts or systems; credential theft; unauthorized access; denial-of-service activity; evasion of security controls; or instructions that materially enable such abuse.
12. Spam and abusive communications. Phishing, spam, unsolicited bulk communications, deceptive promotions, or other contact that violates applicable marketing or communications laws.
13. Interference and platform abuse. Disrupting the Services or connected services; scraping or automated access not expressly authorized by us; bypassing access, safety, payment, rate, credit, or usage controls; reverse engineering where prohibited by the Terms; exploiting vulnerabilities; creating accounts to evade restrictions; reselling unauthorized access; or imposing an unreasonable load on the Services.

These examples are not exhaustive. We may consider the purpose, context, likelihood of harm, and impact on users, third parties, the Services, and our providers when applying this Policy.

You may not use the Services to sell, market, solicit payment for, arrange, or materially facilitate transactions involving:

• illegal drugs, steroids, controlled substances, drug paraphernalia, cigarettes, or products that present an unlawful or serious consumer-safety risk;
• stolen goods, including stolen digital or virtual goods;
• products, services, or fundraising that promote hate, violence, discriminatory intolerance, criminal activity, or the financial exploitation of a crime;
• unlawful obscene material, prohibited sexually oriented material or services, or sexual exploitation;
• counterfeit items or items that infringe intellectual property, publicity, privacy, or other proprietary rights;
• ammunition, firearms, regulated firearm parts or accessories, or weapons and knives restricted by applicable law;
• unlawfully obtained or disclosed personal information;
• pyramid, Ponzi, matrix, fraudulent “get rich quick,” or unlawfully operated multi-level marketing schemes;
• prohibited lottery or annuity contracts, unlawful lay-away arrangements, unlawful offshore banking, or impermissible credit-card-funded debt financing or refinancing;
• goods offered for sale before the seller has lawful control or possession where prohibited by applicable rules;
• unauthorized payment processing for other merchants, money orders, traveller’s cheques, currency exchange, or cheque-cashing services;
• unlawful or unauthorized credit repair, debt settlement, lending, credit, or insurance activities;
• bribery, corruption, kickbacks, or improper payments; or
• products or services that a government authority has identified as presenting a high likelihood of fraud.

Legitimate educational, documentary, journalistic, or analytical discussion of a regulated topic is not prohibited by this section merely because it mentions that topic, provided it complies with the rest of this Policy and does not materially facilitate a prohibited activity or transaction.

Some lawful commercial activities are regulated or present elevated risk. You may not use the Services to operate, advertise, sell, accept payment for, or materially facilitate any activity listed below unless:

1. the activity is lawful in every relevant jurisdiction;
2. you hold all required licences and regulatory approvals;
3. Gamma.design has authorized the use in writing; and
4. each applicable payment or technology provider, including PayPal where PayPal is involved, has granted any prior approval required by its policies.

Approval from Gamma.design does not constitute approval from PayPal or any other provider, and approval from a provider does not constitute approval from Gamma.design. We may decline or withdraw approval at our discretion where permitted by law.

You may not use the Services to make decisions about a person’s eligibility, access, or selection in employment, housing, education admissions, credit, insurance, legal services, or healthcare where the decision is based solely on AI output or unlawfully uses sensitive or personal data.

You must not present AI output as a substitute for qualified medical, legal, financial, or other professional advice, or use inaccurate or deceptive Content in a way that could foreseeably cause material harm.

Sharing and collaboration features do not permit you to use the Services as a general-purpose cyberlocker, public file repository, content-piracy service, or service that rewards uploads. You may not upload or publicly share Content that violates this Policy, even if you did not create it.

You are responsible for selecting appropriate access and sharing settings and for obtaining permission before sharing another person’s Content or information. A public or shareable link may be accessible to anyone who receives it, depending on the available settings.

Your use of third-party models, content sources, integrations, or payment services through or in connection with the Services may also be subject to those providers’ terms and usage policies. You must comply with all such terms that apply to your use.

When PayPal is used in connection with a payment for the Services, PayPal’s Acceptable Use Policy also applies to the PayPal transaction. Nothing in this Policy represents or implies that PayPal has approved any person, content, product, service, or activity.

We may investigate suspected violations and, where appropriate and permitted by law, take one or more of the following actions:

• warn the user or require corrective action;
• refuse or block a request, generation, upload, publication, sharing action, or transaction;
• restrict visibility or remove Content;
• limit, suspend, or terminate access to some or all of the Services;
• preserve relevant information and cooperate with payment providers, rights holders, regulators, or law-enforcement authorities; or
• report conduct or Content where required or permitted by law.

We may take immediate action where we reasonably believe that Content or conduct creates legal exposure, threatens users or the public, compromises the Services, or violates the rules of a provider on which the Services rely. Attempts to evade enforcement, including by creating another account, are prohibited.

To report Content or conduct that may violate this Policy, email support@gamma.design. Please include, where available:

• the relevant URL, account, or shared-content identifier;
• a clear description of the suspected violation;
• supporting information or screenshots; and
• your contact information if you would like us to follow up.

We may update this Policy to reflect changes to the Services, law, risk, or third-party provider requirements. We will post the revised Policy and update the effective date. Where required by law, we will provide additional notice of material changes.
